Eternal provides an online home for rare, unusual, and hand-picked films through eternal.tv, supported applications, streaming channels, newsletters, and related features (collectively, the “Services”). The Services are operated by Eternal Content Ltd., an Alberta corporation (“Eternal,” “we,” “us,” or “our”).
These Terms of Service (the “Terms”) explain the rules that apply when you access or use the Services.
By creating an account, starting a free trial, purchasing a subscription or other offering, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services. Our Privacy Policy explains how we handle personal information.
Nothing in these Terms limits any consumer-protection, privacy, or other legal rights that cannot lawfully be waived.
Eternal provides access to licensed and owned audiovisual content through eternal.tv and supported mobile, television, and other applications. Features may include on-demand streaming, 24/7 programmed channels, editorial collections, watchlists, viewing progress, newsletters, and occasional rentals, purchases, or other offerings.
Eternal is primarily offered in Canada and the United States. Access from other countries may be permitted, but the available catalogue may be substantially smaller because many titles are licensed only for particular territories. We may use IP address, account, payment, or device information to determine territory and enforce licence restrictions.
You may not use a virtual private network, proxy, false account information, or another method to misrepresent your location or defeat territorial, device, or content-access restrictions.
You must provide accurate, current information and keep it updated. You are responsible for safeguarding your sign-in credentials and for activity occurring through your account. Tell us promptly at family@eternal.tv if you suspect unauthorized access.
An account may be registered on up to five devices at a time. The number of simultaneous streams or other technical limits may depend on the plan, app platform, device, or reasonable measures used to prevent abuse. You may manage or remove registered devices through available account settings. We may reset or restrict device access when reasonably necessary to address fraud, security, licensing obligations, or misuse.
Your account is for personal and non-commercial use by you and people you permit to use your account for ordinary private viewing. You may not sell, rent, transfer, sublicense, or commercially share your account or access credentials.
Eternal is a general-audience service. Depending on the platform, its applications are rated 13+ or Teen. A paid subscription must be purchased and managed by someone who has reached the age of majority where they live. Younger viewers may use an adult-managed account with the permission and supervision of a parent or legal guardian. Children under 13 may not create their own account.
Some titles may contain horror, violence, disturbing imagery, coarse language, mature themes, or culturally dated material. The adult account holder is responsible for deciding what is appropriate for other viewers using the account. Ratings, warnings, genres, and descriptions are provided as guidance and may vary by title or region.
Available plans, prices, billing periods, trial periods, and included features are displayed at checkout and may change from time to time. Unless the checkout page clearly says otherwise, prices are shown in U.S. dollars and applicable taxes may be added.
If a free trial is offered, the checkout page will state its length, the plan that begins after the trial, the price, and the billing frequency. Unless you cancel before the trial ends, the trial automatically converts to the selected paid subscription and your payment method will be charged.
Paid subscriptions renew automatically for successive periods matching the selected plan—monthly, quarterly, annually, or as otherwise disclosed at checkout—until cancelled. By starting a trial or subscription, you authorize the applicable payment provider to charge the displayed recurring price, plus taxes, to your selected payment method at the end of the trial and on each renewal date.
For quarterly and annual subscriptions billed directly by Eternal, we send a renewal reminder by email about 30 days before the renewal date. Third-party platforms may use their own notice schedule and method.
We may change subscription prices or plan features. When required by law, we will provide advance notice of a material change and explain when it takes effect and how to cancel. A price change will not retroactively alter a period that has already been paid for.
Payments may be processed by Uscreen, Stripe, PayPal, an app marketplace, or another disclosed payment provider. You authorize the relevant provider to store and use your payment method under its own terms and privacy practices. Eternal generally does not receive or store your complete payment-card number.
You may cancel an Eternal-billed subscription through the membership or billing settings in your account. Cancellation stops the next renewal, and you will normally retain access through the end of the period already paid for. Deleting an app, signing out, or ceasing to watch does not cancel a subscription.
If Apple, Google Play, Roku, Amazon, or another platform bills you directly, its billing, cancellation, and refund rules also apply. You must normally manage that subscription through the same platform.
You are responsible for keeping your payment information current. If a payment fails, we or the billing provider may retry the charge, suspend paid access, or ask you to update your payment method.
Payments are generally non-refundable once a billing period has begun, except where required by law or the billing platform’s rules. If you are dissatisfied or believe a charge was made in error, contact family@eternal.tv. We review reasonable refund or credit requests in good faith and may provide an accommodation at our discretion.
A discretionary refund or accommodation does not create an obligation to provide the same result in another situation. Nothing in this section limits any non-waivable refund, cancellation, chargeback, or consumer rights.
While your account is active and in good standing, Eternal grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable right to access the Services and view available content for personal, private, non-commercial use in authorized territories.

Our catalogue changes regularly. Titles, versions, subtitles, artwork, 24/7 channel schedules, collections, and features may be added, removed, replaced, edited, delayed, or restricted because of licensing terms, legal requirements, technical issues, or editorial decisions. A subscription provides access to the catalogue available to your plan and territory at that time; it does not guarantee continued access to any particular title or feature.
Playback quality depends on factors outside Eternal’s control, including your connection, bandwidth, location, device, display, operating system, app version, and third-party networks. We may perform maintenance or experience interruptions. We do not guarantee uninterrupted, error-free, or identical service across all devices and territories.
The Services, including their design, software, text, graphics, logos, trademarks, editorial materials, compilations, and interfaces, are owned by or licensed to Eternal and are protected by copyright, trademark, and other laws. Films and other audiovisual works are owned or controlled by their respective rights holders. No ownership rights are transferred to you.
If you believe content available through Eternal infringes your copyright or other rights, email family@eternal.tv. Include your contact information, identification of the protected work, the specific Eternal URL or location, an explanation of the claimed infringement, and confirmation that you are the rights holder or are authorized to act for them. We may request additional information or restrict content while reviewing a complaint.
The Services may interact with third-party platforms, devices, payment services, app stores, websites, or social networks. Those services are controlled by their operators and may have separate terms and privacy practices. Eternal is not responsible for a third party’s service, content, security, availability, or decisions, except to the extent responsibility cannot lawfully be excluded.
We may send service-related communications that are reasonably necessary to operate your account, such as receipts, password resets, security notices, support responses, cancellation confirmations, renewal information, and material changes to the Services or these Terms.
When you create an account, start a trial, or purchase a subscription, we may add your email address to Eternal’s mailing list and send newsletters, new-release announcements, recommendations, and promotional offers where permitted by law. You may unsubscribe from marketing at any time using the link in an email or by contacting family@eternal.tv. Receiving marketing emails is not required to maintain your account or subscription, and unsubscribing does not stop necessary account or transactional messages.
We may investigate suspected misuse and may restrict, suspend, or terminate access if we reasonably believe you have materially breached these Terms, engaged in fraud or unlawful activity, created a security risk, infringed rights, or caused Eternal to violate a legal or licensing obligation. Where reasonable, we will give notice and an opportunity to resolve the issue.
You may stop using the Services at any time, but you must cancel an active subscription to stop future recurring charges. Sections that by their nature should survive termination—including intellectual-property, payment, liability, dispute, and miscellaneous provisions—will continue to apply.
If Eternal permanently discontinues a prepaid subscription service before the end of your paid period for reasons unrelated to your breach, we will provide any refund, credit, substitute access, or other remedy required by applicable law.
To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis. Eternal disclaims implied warranties or conditions of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that every title, description, subtitle, rating, recommendation, or other item will be complete, accurate, available, or suitable for you.
To the fullest extent permitted by law, Eternal and its directors, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity, arising from the Services.
To the fullest extent permitted by law, Eternal’s total liability arising from or relating to the Services or these Terms will not exceed the greater of (a) the amount you paid to Eternal for the Services during the 12 months immediately before the event giving rise to the claim, or (b) CAD $100.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any liability or remedy that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
To the extent permitted by law, you agree to reimburse Eternal for reasonable losses, liabilities, and legal costs resulting from a third-party claim caused by your unlawful use of the Services, your infringement of another person’s rights, or your material breach of these Terms. Eternal will give you reasonable notice of such a claim and will not settle it in a way that imposes an admission or non-monetary obligation on you without your consent, which will not be unreasonably withheld.
We may update these Terms to reflect changes to the Services, our business, technology, or law. Non-material changes take effect when posted. Before a material change takes effect, we will provide additional notice when reasonably required, such as through the Services or by email.
If you do not agree to revised Terms, you should stop using the Services and cancel any renewing subscription. Continued use after the revised Terms take effect constitutes acceptance where permitted by law.
These Terms are governed by the laws of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law rules. Subject to any rights you have to bring a claim in your home jurisdiction, the courts of Alberta will have exclusive jurisdiction over disputes relating to these Terms or the Services.
Nothing in this section deprives a consumer of mandatory protections available under the laws of the consumer’s province, state, or country. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
These Terms, our Privacy Policy, and any plan-specific terms shown at checkout form the agreement between you and Eternal regarding the Services. If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver.
You may not assign these Terms without our written consent. Eternal may assign them in connection with a merger, reorganization, financing, sale of assets, or transfer of the Services, subject to applicable law. Headings are for convenience only.
